A thriving North-East England based retail business had suffered a sharp downturn in fortunes when their landlord embarked on a substantial construction project within the grounds of their premises. The business never recovered and entered liquidation in October 2014.

The landlord is a major listed UK Plc Commercial Property Group and, supported by a large and well respected law firm, refused to engage in commercial discussions with the Office Holder.

Manolete Partners purchased the claim and financed a strong Letter Before Action. It was clear from the tardy responses from the Property Group they were aiming to delay the process for as long as possible in the hope that we might not pursue the claim. That is never our approach and so we threatened to issue formal proceedings. Finally a mediation was agreed to by the Property Group. They then cancelled the original mediation presumably to further test our resolve.

A mediation finally took place in Leeds and soon after a settlement was agreed at £75k, which covered all of the creditor deficiency in full as well as all the costs of the liquidation. Justice had finally been served.
